The exact information collected depends on the technologies and services installed on the website.
3. How we use your information
We may use your information to:
- Respond to enquiries;
- Arrange and manage appointments;
- Provide the services you have booked;
- Assess the suitability of a service;
- Maintain appropriate client records;
- Communicate with you about appointments;
- Process payments;
- Send appointment confirmations and reminders;
- Manage cancellations and changes;
- Deal with queries and complaints;
- Maintain business and financial records;
- Meet legal and regulatory obligations;
- Protect the security of our website, systems, clients and business;
- Improve our services and website; and
- Send marketing communications where we have an appropriate lawful basis to do so.
We will not use your health information for unrelated marketing purposes.
4. Lawful basis for processing
Depending on the circumstances, we may process personal information because:
- It is necessary to perform a contract with you or take steps at your request before entering into a contract;
- It is necessary for us to comply with a legal obligation;
- It is necessary for our legitimate interests, where those interests are not overridden by your rights and interests; or
- You have provided consent where consent is required.
Where we process special category health information, we will rely on an appropriate condition under UK data protection law in addition to an Article 6 lawful basis.
Where explicit consent is required, we will ask for it separately and will not assume consent simply because you have booked an appointment.
5. CliniForm — consultation, client records and booking information
Restore & Perform uses CliniForm to provide client consultation forms, consent forms, client records, treatment notes and related practice-management functionality.
CliniForm is a UK-based service operated by SquareCode UK Limited, company number 17298176, with its registered address at 128 City Road, London, EC1V 2NX.
CliniForm states that it provides UK-hosted infrastructure and uses TLS 1.2+ encryption for data in transit and AES-256 encryption for health records at rest.
Where you submit consultation or health information to Restore & Perform through CliniForm:
RESTORE AND PERFORM WELLNESS LTD is normally the data controller for that client information.
CliniForm processes that information on our instructions as a data processor.
CliniForm states that consultation forms may contain special category data, including health information, and that practices are responsible for ensuring an appropriate Article 9 UK GDPR condition applies before collecting such information.
We use CliniForm because it allows consultation information, consent, client records and treatment notes to be maintained separately from the public WordPress website.
6. CliniForm and special category health information
Where you provide health information through a Restore & Perform consultation or health questionnaire, that information may constitute special category personal data.
We only request information that is relevant to assessing the suitability and delivery of the services we provide.
We will not use health information for unrelated marketing purposes.
You should provide accurate and up-to-date information and tell us about relevant changes to your circumstances.
CliniForm states that special category information submitted through consultation forms is processed only on documented instructions from the practice and subject to its data-processing terms.
7. WordPress website
Our public website is built using WordPress and hosted by Hostinger.
WordPress is primarily used as the public website and marketing platform for Restore & Perform.
Where CliniForm consultation forms are embedded into the website, CliniForm’s integration is used so that consultation submissions are processed by CliniForm rather than being stored as clinical records within WordPress.
CliniForm states that its WordPress integration uses a practice-specific API key and registered website address and that consultation submissions continue to be handled within CliniForm.
The website may contain additional WordPress plugins required for website functionality.
The exact plugins installed may change from time to time. Where a third-party plugin processes personal information, its processing will be considered when this Privacy Policy and our Cookie Policy are reviewed.
8. Hosting
Our website is hosted using Hostinger.
Hostinger may process technical information required to operate, secure and maintain the website.
Personal information submitted through ordinary website contact forms may be processed through the relevant WordPress/hosting/email services used by the website.
We will take reasonable steps to ensure that third-party services are appropriately selected and configured.
9. Booking and payment services
Restore & Perform uses CliniForm for appointment booking and related practice-management functions.
CliniForm’s platform provides online booking, calendars, reminders, appointment management and payment functionality. Its current documentation identifies Stripe as its payment integration for online payments.
Where you make an online payment, your payment information may therefore be processed by Stripe and/or another payment provider made available through CliniForm.
Payment card details are not intended to be stored directly in the Restore & Perform WordPress website.
The relevant payment provider’s own privacy policy and terms will apply to its processing of payment information.
10. Who we may share information with
We may share personal information where necessary with:
- CliniForm, for booking, consultation, client records and related services;
- Payment providers, including Stripe where used;
- Hostinger and relevant website/technical service providers;
- Professional advisers such as accountants or insurers;
- Legal or regulatory authorities where required; and
- Healthcare professionals where appropriate and lawful, including where necessary to protect your health or safety.
We do not sell your personal information.
11. International data transfers
CliniForm states that its infrastructure is UK-hosted and that where personal data is transferred outside the UK it uses appropriate safeguards under UK GDPR Chapter V, such as the UK International Data Transfer Agreement or an adequacy decision.
Other third-party services used by our website may process information outside the UK.
Where this occurs, we will ensure that an appropriate lawful transfer mechanism or safeguard is in place where required by UK data protection law.
12. How long we keep information
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including legal, accounting, insurance, dispute-resolution and record-keeping requirements.
Different categories of information may be retained for different periods.
We will periodically review information held and securely delete or anonymise information that is no longer required.
Where information is held within CliniForm, its retention and deletion functionality will also apply.
13. Keeping your information secure
We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
CliniForm states that it uses TLS 1.2+ encryption in transit and AES-256 encryption for health records at rest.
However, no internet transmission or electronic storage system can be guaranteed to be completely secure.
14. Your data protection rights
Depending on the circumstances, you may have rights under UK data protection law including:
- The right to be informed about how your information is used;
- The right to request access to personal information we hold about you;
- The right to request correction of inaccurate information;
- The right to request deletion of information in certain circumstances;
- The right to request restriction of processing in certain circumstances;
- The right to object to certain processing;
- The right to data portability in certain circumstances; and
- The right to withdraw consent where processing is based on consent.
Some rights are subject to legal exceptions.
Where CliniForm processes information on our behalf, we may need to involve CliniForm in responding to a request.
CliniForm also provides information about exercising data protection rights where it acts as a controller or processor.
15. Marketing
We will only send marketing communications where we have a lawful basis to do so.
You can unsubscribe from marketing communications at any time.
Unsubscribing from marketing does not affect service-related communications such as appointment confirmations, reminders or important information about your booking.
16. Cookies
Our website may use cookies and similar technologies.
Some are necessary for the website to operate, while others may be used for analytics or other purposes.
Where consent is required, non-essential cookies will only be used after you have provided the appropriate consent.
Please see our Cookie Policy for further information.
17. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, technology, third-party providers, legal requirements or how we process information.
The latest version will always be published on this website.
18. Complaints
If you have concerns about how we have handled your personal information, please contact us first:
You also have the right to complain to the Information Commissioner’s Office (ICO), the UK’s data protection regulator.
